These Seeqle General Terms and Conditions (the "General Terms and Conditions") govern the relationship between Seeqle, a simplified joint stock company with a capital of 24,514 euros, registered in the Paris Trade and Companies Register under number 809 063 142, whose registered office is located at Place Thiers- 54 064 NANCY France, represented by Dorian Liegeois, duly authorised for the purposes hereof (hereinafter "Seeqle") and any person (the "User") wishing to use the Seeqle website accessible at the address (the "Site") and/or the mobile device application (e.g, telephone, tablet) made available to Users by Seeqle (the "Application").
Seeqle and the User are hereinafter referred to individually as a "Party" and collectively as the "Parties".
The General Conditions define the conditions under which the User may use the Site, in particular in order to:
- Publish its professional profile online in order to make it accessible to companies (in which case the User is referred to as "Candidate");
- Access the analyses of the algorithm that will have been previously identified by Seeqle (in which case the User is referred to as "Company");
- benefit from the additional services, subject to payment, offered by Seeqle (the "subscription"), such as in particular:
Article 1 - Registration
In order to register on the Site and/or the Application, the User must complete the fields of the registration form with complete and accurate data.
In the event of an incomplete or incorrect declaration, the User's account may be closed, without notice and without prior formality and the User agrees to indemnify Seeqle for all consequences that may result from such incomplete or incorrect declaration.
The User creates an account using the e-mail address he has provided to Seeqle.
On subsequent visits, the User will simply enter his e-mail address (used as a login ID) and password. For security and confidentiality reasons, it is recommended that the User choose passwords composed of several types of characters, and modify them regularly.
Article 2 - Users' accounts
The personal account of each User allows him to update the data concerning him
The username and password are unique and personal. They must not be disclosed to third parties. Any use of the Site and/or the Application made using a User's username and password shall be deemed to have been made by the User. In case of disclosure of his username and password, the User must contact as soon as possible so that they can be deactivated.
2.1 Candidates' Accounts
The Candidate is free to fill in all the fields that are made available to him on the Site and/or the Application. As such, it declares and guarantees that all the elements it mentions are accurate and verifiable and that it is authorized to use and distribute them on the Site. In particular, the Candidate guarantees Seeqle against any claim or recourse based on the fact that one of the elements that the Candidate distributes via his User account infringes the rights of a third party (e.g., infringement, breach of a confidentiality agreement, unfair competition).
In particular, the Candidate shall refrain from publishing information and/or proposing an application for a position on behalf of a third party.
The Candidate grants Seeqle the right to use its image in the context of the exploitation and distribution of its profile under the conditions defined in the General Conditions as well as the advertising and promotion of the Site.
Seeqle may not use the Candidate's image in connection with derivative products related to the Site and/or the Application without the prior consent of the Candidate, any refusal on his part being duly justified, and without the prior and good faith determination between Seeqle and the Candidate of a fair remuneration.
However, it is specified that promotional publications and films related to the Site, as well as the distribution of promotional material for the Site, are not considered as derived products.
Applicants must accept the T&Cs that provide for their data to be used anonymously and for statistical purposes for the Seeqle recommendation engine.
2.2 Company accounts :
The company is free to fill in all the fields that are made available to it on the Site and/or the Application. As such, it declares and guarantees that all the elements it mentions are accurate and verifiable and that it is authorized to use and distribute them on the Site. In particular, the company guarantees Seeqle against any claim or recourse based on the fact that one of the elements broadcast.
